Official Rules

NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.

PARTICIPATION CONSTITUTES ENTRANT’S FULL AND UNCONDITIONAL AGREEMENT TO BE BOUND BY THESE OFFICIAL RULES.

  1. SPONSOR AND CONTACT INFORMATION. The sponsor of the Contest and the address at which the Sponsor may be contacted is: GoSeeTell Network ("Sponsor"), 3108 NW Luray Terrace, Portland, OR 97210
  2. ELIGIBILITY. The GoSeeMunich / "My Munich Memories Contest" (the "Contest") is only open to entrants who, as of the entry date, are at least eighteen (18) years old. Entrants must have Internet access and must be the rightful owner or have authorized use of an e-mail account prior to September 22nd, 2008, the date the Contest is first made known to the public. In the event of a dispute concerning the identity of the winner submitting an entry, the winner will be deemed to be the person in whose name the e-mail account is opened. The Contest is void where prohibited or restricted by law.

    Employees, officers, directors, and agents of GoSeeTell Network, Destination Marketing Organizations in Munich and their respective parents; subsidiaries; affiliates; assigns; advertising, public relations and promotion agencies; attorneys and other representatives; and the immediate families (defined as parents, spouses, children, siblings, grandparents, and their respective spouses) or members of the same household (whether related or not) of each such employee, officer, director, and agent, as well as the persons with whom each of the above are domiciled, are not eligible to enter.

    All entrants must meet these eligibility requirements to qualify for the prize. All non-eligible entrants will be disqualified from the Contest.
  3. TIMING. The Contest entry period begins at 12:01 a.m. Pacific Standard Time ("PST") on September 22, 2008 and ends at 11:59 p.m. PST on December 21st, 2008 (the "Entry Period"). Sponsor’s computer is the official time-keeping device for the Contest.
  4. HOW TO ENTER.

    NO PURCHASE NECESSARY OF ANY KIND TO ENTER OR WIN.

    1. For the contest Sponsor will ask entrants to share recommendations for travel products for Munich. Each entrant is required to submit a tip or review about a tourism-related activity or destination in Munich ("Tip"). An entrant will receive one sweepstakes entry for each tip added to the GoSeeMunich.com site during the duration of the sweepstakes.
    2. Each entry must be submitted online. During the Entry Period, entrants should go to www.goseemunich.com and follow the links and instructions for adding a Tip. Entrant must check the box on screen opting into the contest. Failure to submit all required information and submissions in the manner required in these Official Rules may result in disqualification. Entries will not be acknowledged or returned. Proof of submission will not be deemed to be proof of receipt by Sponsor.
    3. All submissions in the Contest by an entrant must be the entrant’s own original creation (an original is the product of one’s own mind and is not a copy or imitation), created solely by the entrant. Submissions must not have been published previously, in whole or in part. Modifying, enhancing or altering a third party’s preexisting work does not qualify as an entrant’s original creation. Each submission must be in keeping with the Sponsor’s image and may not be offensive or inappropriate, as determined by Sponsor in its sole discretion, nor can it defame or invade publicity rights or privacy of any person, living or deceased, or entity, or otherwise infringe upon or violate any person’s or entity’s personal, intellectual property or property rights or any other third-party rights. Sponsor reserves the right, in its sole discretion, to disqualify any entry Sponsor deems, in whole or in part, to be offensive, inappropriate or that is not in keeping with Sponsor’s image. Any submission that does not comply with any aspect of these Official Rules may be rejected by Sponsor, and the entrant of such a submission may be disqualified.
    4. Each entry and related submissions, including, without limitation, all contents, concepts and ideas embodied therein, becomes the exclusive property of Sponsor when submitted. Each entrant agrees that Sponsor and its successors, assigns, licensees and designees shall have the perpetual, irrevocable, world-wide and fully-transferable right (but not obligation) to use, modify, display, reproduce, make derivative works of, and otherwise exploit entrant’s entry and submissions (or any part thereof) for promotional purposes in any manner or any and all media whether now known or hereafter developed and/or to otherwise use or commercially exploit any entry or submission (or any part thereof) or information or ideas contained within any entry or submission, all without further payment, consideration, attribution, notice or consent. Sponsor shall have no obligation to maintain any of the entries or submissions, or any information or ideas contained therein, as confidential or proprietary. Sponsor reserves to right to edit, modify, or abridge any such entry or submissions for any reason prior to use.
    5. All entrants and entries are subject to verification by Sponsor. Sponsor reserves the right to conduct a background check on any or all entrants, and Sponsor reserves the right to disqualify any individual based on such background check if Sponsor determines in its sole discretion that awarding a prize to any such individual might reflect negatively on Sponsor. Entrants will cooperate with Sponsor and its representatives in connection with any and all verification and background check activities.
  5. AGREEMENT TO OFFICIAL RULES AND DECISIONS. By participating in the Contest, each entrant fully and unconditionally agrees to be bound by and accepts these Official Rules and the decisions of Sponsor and its judges (including, without limitation, decisions regarding eligibility of entries, the selection of winners, and the awarding of prizes), which are final and binding in all respects. Each entrant must comply with all the terms and conditions of these Official Rules, and winning is contingent on fulfilling all requirements hereunder. Entrants agree to waive any right to claim ambiguity in the Contest and/or these Official Rules.
  6. SELECTION; NOTIFICATION
    1. Winners will be selected in a random drawing in the week after the contest closes.
    2. Potential winners need not be present to win. A potential winner will be notified by email. The potential winner will have forty-eight (48) hours to return the email SPONSOR and accept the prize. Failure to respond within forty-eight (48) hours of notification will deem the potential winner to have forfeited the prize, and an alternate potential winner will be chosen. Returning the email will not automatically make the potential winner a contest winner.

      As a condition of winning and claiming a prize, each potential winner will be required to execute and return to Sponsor an Affidavit of Eligibility (which will verify that the potential winner meets the eligibility requirements), a Liability Release and (where lawful) a Publicity Release (collectively, an "Affidavit/Release"), as well as his/her social security number used for reporting the winnings to the Internal Revenue Service as required by law. The Affidavit/Release and social security number must be returned to Sponsor within five (5) days of the date specified on the accompanying notification letter. If the prize notification or prize is returned undeliverable, if the potential winner does not return the notification email or call Sponsor within forty-eight (48) hours of Sponsor’s first attempt to contact the potential winner by email, if the potential winner fails to return the Affidavit/Release and social security number within the required five- (5-) day period, if the potential winner is found to be ineligible, or if the potential winner does not comply with the Official Rules, then the potential winner may be disqualified and an alternate potential winner may be selected by Sponsor in his/her place, which alternate shall be drawn at random as well. In such event, an alternate potential winner will be notified by Sponsor by email as described above and will be required to return the required documents to Sponsor as described above; however, Sponsor, in its sole discretion, may adjust the above timing and delivery requirements to accommodate Sponsor’s Contest schedule, and due to such schedule and timing, Sponsor may be unable to award the prize with respect to the disqualified potential winner. Sponsor is not responsible for the failure of a potential winner to receive Sponsor’s email notification or the required documents for any reason, or for the inability of such potential winner to return Sponsor’s email or call Sponsor or to return the required documents for any reason. Should any winner make any false statements in any document referenced herein, the winner will be required to promptly return his/her prize to Sponsor. Winners agree that they will not conduct or participate in any media interview regarding this Contest or any prize without the express prior written permission of Sponsor, which permission may be withheld for any or no reason.
  7. PRIZES
    For this Contest one grand prize is provided consisting of:

    • 3 nights in a four start hotel
    • 1 dinner for two at the famous Hofbräuhaus
    • MVV City Tour Card for 2 for 2 days
    • Hop-on-hop-of city tour for 2
    • 2 Tickets for GOP Variete
    The approximate retail value of this prize is Euro 600 / USD 900.

    The hotel prizes only cover accommodation at the resorts and do not include incidentals (spa, room service, gratuities etc.). Transportation to and from Munich are not included. Prize must be claimed and used by 12/31/2009. Certificates cannot be replaced if lost/stolen or extended beyond expiration date.

    LIMIT: One (1) prize per individual, family, or household. Prize will be awarded provided there are at least five (5) eligible entrants and provided all other conditions of receipt of the prizes set forth herein are met. No prizes will be awarded to any entrant who violates these Official Rules or any applicable law.

    Prizes must be accepted as awarded, and prizes are awarded “AS IS” with no warranty, representation, or guarantee, express or implied, in fact or in law, made by Sponsor or for which Sponsor may be liable, including, without limitation, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OR FITNESS FOR A PARTICULAR PURPOSE. The selected entrants must comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. Prizes are non-transferable, non-assignable and non-refundable. No cash or other substitution may be made, except by Sponsor, who reserves the right (but has no obligation) to substitute the prizes (or components thereof) with other prizes (or components thereof, including cash) of equal or greater value if the prizes (or any components thereof) are not available for any reason as determined by Sponsor, in its sole discretion. Prize winners will be issued IRS Forms 1099 for the approximate retail value of the prizes. Sponsor expressly disclaims any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use of prizes awarded. Sponsor makes no representation or warranties concerning the appearance, safety, or performance of any prizes awarded. Any maintenance and warranties shall be limited to those provided by the manufacturer of the prizes, and acceptance of the prizes constitutes the winners’ release of Sponsor for maintenance and/or repair of the prizes.
  8. ODDS OF WINNING. THE ACTUAL ODDS OF WINNING DEPEND ON THE NUMBER OF ELIGIBLE ENTRIES RECEIVED
  9. PUBLICITY. Except where prohibited or restricted by law, participation in the Contest constitutes entrant’s consent to Sponsor’s (and its successors’, assigns’, licensees’ and designees’) use of entrants’ names; biographies; likenesses; voices; photographs; videos; opinions; statements made by or attributed to them; hometowns, states and countries; and prizes won for promotional or other purposes in any manner and in any and all media now known or hereafter developed (including, without limitation, print, broadcast, and Internet), worldwide, in perpetuity, and without further payment, consideration, consent or notice. Entrance in the Contest constitutes the winners’ consent to Sponsor’s sale of the foregoing personal identification information. Entrants will not be required to disclose any personal financial information to enter the Contest.
  10. GENERAL CONDITIONS. Sponsor reserves the right to cancel the Contest at any time without obligation or prior notice for any or no reason. Sponsor further reserves the right, in its sole discretion, to terminate, modify or suspend the Contest without obligation or prior notice if, in Sponsor’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Contest, or if computer viruses, bugs, unauthorized intervention, fraud, technical difficulties or failures or any other factor beyond Sponsor’s reasonable control, compromise, corrupt or affect the administration, security, fairness, integrity or proper operation of the Contest. In such event, Sponsor reserves the right (but does not have an obligation) in its sole discretion to award the prizes based on the above judging criteria from among eligible, non-suspect entries received up to the time of suspected impairment. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS, AND, SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING COSTS AND ATTORNEYS’ FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
  11. RELEASE. By entering, each entrant forever and irrevocably releases and holds harmless Sponsor, its parents; subsidiaries; affiliates; agents; attorneys; representatives; advertising, public relations and promotion agencies; Contest partners; prize suppliers; and all of their respective employees, officers, directors, shareholders and agents from and against all claims, damages or liabilities arising in whole or in part, directly or indirectly, from entrant’s participation and/or entry in the Contest; the administration of contest; entrant’s award, acceptance, receipt, possession, use, or misuse of any prize awarded in the Contest; and entrant’s participation in any prize or contest related activities.

    By accepting the prizes, the winners agree to release, discharge, and hold harmless Sponsor and its parents, affiliates, subsidiaries, assigns, attorneys, representatives, and agents, including advertising and promotion or fulfillment agencies, from any and all liability arising out of use of the prize. Winners assume all liability for any injury or damage caused, or claims to be caused by participation in the Contest or use or redemption of any prize. Upon delivery of the prizes to the winners, Sponsor will be deemed to have awarded the prize to the winners with winners assuming full responsibility for the prizes.
  12. LIMITATIONS OF LIABILITY. Sponsor is not responsible for: (a) incorrect or inaccurate transcription of entry information or late, lost, stolen, unintelligible, illegible, damaged, mutilated, altered, incomplete, misdirected entries or Affidavits/Releases or entries received through impermissible or illegitimate channels, all of which will be disqualified; (b) technical failures of any kind, including but not limited to the malfunctioning of any telephone, computer online systems, computer equipment, web site, server provider, network, hardware or software; (c) the unavailability or inaccessibility of any telephone, mail, website or service; (d) unauthorized intervention in any part of the entry process or the Contest; (e) printing, typographical, electronic or human errors that may occur in the offer or administration of the Contest, the processing of entries, the announcement of prizes, or in any Contest-related materials; (f) any injury or damage to persons or property, including but not limited to entrant’s computer, related equipment, data files and software, which injury or damage may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest; from viewing, playing or downloading any material from Sponsor’s web site(s); from the inability to access any website associated with the Contest; or any combination thereof, regardless of whether the injuring or damaging material was prepared by Sponsor or a third party, and regardless of whether the material is connected to Sponsor’s web site by a hypertext link; (g) any injuries, losses, or damages of any kind arising in connection with or as a result of the entrant’s access to and use of the website www.goseemunich.com and the participant’s entry into the Contest to the extent permitted by law, including, without limitation, personal injury, death, or property damage and claims based on publicity rights, defamation, or invasion of privacy; or (h) any condition caused by events beyond the control of Sponsor that may cause this Contest to be disrupted or corrupted.
  13. DISPUTES. Entrants agree that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Contest, or any prizes awarded shall be resolved individually, without resort to any form of class action, and solely and exclusively in a federal or state court located in Multnomah County, Oregon; entrants submit to sole and exclusive personal jurisdiction to said courts in the State of Oregon for any such dispute and irrevocably waive any and all rights to object to such jurisdiction; (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket expenses incurred, including costs associated with entering this Contest but in no event attorneys’ fees; and (c) under no circumstances will entrants be permitted to obtain awards for and entrants hereby waive all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant or Sponsor in connection with the Contest shall be governed by, and construed in accordance with, the laws of the State of Oregon, without giving effect to any conflict of law rules or provisions (whether of the State of Oregon, the United States, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Oregon.

    This Contest is subject to all applicable federal, state, and local laws and regulations.
  14. DATA COLLECTION. Sponsor collects personal information from entrants when they enter the Contest. The information collected is subject to the Privacy Policy of Sponsor. Nothing contained herein shall limit Sponsor’s publicity rights as described in Section 9 above. Entrants will not be required to disclose any personal financial information to enter the Contest.
  15. OFFICIAL RULES. These Official Rules are available online at www.GoSeeMunich.com at the contest section of the website or by sending a self-addressed postage-stamped envelope to GoSeeTell Network, 3108 NW Luray Terrace, Portland, OR 97210. Residents of Vermont need not affix return postage.
  16. WINNER’S LIST. To request a list of winners, email your request to contest@goseetell.com or send a self-addressed postage-stamped envelope to GoSeeTell Network, 3108 NW Luray Terrace, Portland, OR 97210. Residents of Vermont need not affix return postage.

    All such requests must be received prior to December 31st, 2009.
  17. CONSUMER DISCLOSURE. You have not yet won. No purchase or payment is necessary. The one (1) prize that will be awarded is worth $900. The actual odds of winning depend on the number of eligible entries received.
